Independent Expert Witness
The Courts rely heavily on Expert Witness evidence and opinion. To do so they must be able to accept that an Expert Witness is truly an Expert. Meth Xpert New Zealand specialises in methamphetamine contaminated property consultancy, and hold industry recognised qualifications in order to act as your Independent Expert Witness.
Our function as an expert witness is to assist a decision-maker (Adjudicator or Judge) in reaching a proper decision by giving an independent, objective assessment ant technical qualification of the methamphetamine contamination issues that are the subject of the expert opinion. Meth Xpert New Zealand can also provide factual evidence, such as direct observations at a site.
An expert must possess strong qualifications in the technical areas and issues that are the subject of the expert opinion. Meth Xpert New Zealand are NZQA Certified and were IANZ Accredited as an Independent Inspection Body from 2018 until 2022, These qualifications demonstrate expertise and technical competency, and are the formally recognised qualification for sampling and reporting in accordance with NZS 8510:2017 from Screening Assessments through to Detailed Site Assessments and Post Remediation Assessments. Meth Xpert have been requested and acted as independent Expert Witnesses in a range of cases within the following courts.

What we do
Meth Xpert will carefully prepare an expert witness statement. In our preparations we are bound by Schedule 4 of New Zealand Legislation High Court Rules 2016, The Code of practice for expert witness.
Conflict of Interest
Meth Xpert New Zealand must consider whether they have any personal or business relationships with any of the parties in the legal proceeding that may give rise to a conflict of interest. Meth Xpert NZ will further consider whether any of their clients could be disadvantaged by their participation as an expert, even though the client is not involved in the legal proceeding.
If a conflict of interest is discovered, Meth Xpert New Zealand will immediately advise both the client and legal counsel so they can make an informed decision with respect to retaining Meth Xpert New Zealand as an expert witness. If Meth Xpert New Zealand cannot satisfactorily conclude that no conflict of interest exists, we will be required to decline to act as an expert witness.
It is not appropriate for an expert witness to give an opinion on whether a contract or a provision of a contract has been breached or met. This is a finding of law reserved for the decision-maker. It is acceptable for an expert to give opinion evidence on practice or industry-based assumptions and interpretations underlying the language of contracts or documents. There is one exception to this: an expert can provide a decision-maker with an opinion as to the meaning of technical or scientific terms.
